Technically aye, but no one is ever going to chase you down for information technology, particularly if they can't prove meaning damages.

If the person who owns it had enough juice in the legal system certain.

But they'd have to find a lawyer to take up the case and a judge to hear it.

Then they'd have to fight you to collect.

General rule of thumb: Don't sue unless you lot're sure you can collect.

Yous know all those lawyers who advertise "no fee unless y'all win".

You tin can sue me for a meg dollars and they'd want their twenty% regardless of if I pay you or not.

Nope, that's not really how it works. But by and large speaking copyright holders don't give a shit if you want to employ their thing as an avatar.

Assuming you are in the US?

Short reply: Legally, yeah, it is copyright infringement. Reproducing an unabridged work is well-nigh never considered fair utilise, either.

Longer answer: Chances are nobody would observe out, and even if they did, it'southward not worth pursuing information technology nether the circumstances. Enquire for permission if y'all're that worried nigh it.

The art i wanted to use has the creator'south website printed in the elevation right corner already. This should be ok correct? since everyone would know that is the guy who made the picture. And yes in the U.S.

Technically no. You're still reproducing their work without permission.

But once again, for something as silly as a forum avatar, no one is ever going to go all the effort to sue y'all. Their courtroom fees would be substantially more than they could ever hope to go out of information technology, even if they bizarrely went through all the endeavor to observe you.

Or y'all could utilise something that gives you permission explicitly.

Weebl's Stuff, the company that makes Magical Trevor, my avatar, explicitly says we're allowed to use images from their stuff for personal not-commercial use.
